I won the case, because I won it in the Appellate Division. …I won the case because it’s called statute of limitations. The appeals court never said he won the case. The cutoff date would’ve been February 6, 2016, for any defendants Engoron decided weren’t covered by the agreement.) After Trump wrongly claimed to reporters, following the first day of the trial, that “about 80% of the case is over” because of the appeals court ruling, Engoron said in court the next day: “This case arrived at the App.

CNN —A New York judge has imposed a gag order on Donald Trump, limiting the former president from making statements about potential witnesses in the criminal trial relating to hush money payments scheduled to begin next month. The order does not prevent Trump from talking about New York District Attorney Alvin Bragg, who is a public figure, or Merchan himself. Trump criticized Merchan, his daughter and one of Bragg’s prosecutors in the hours before Merchan issued his order. The district attorney’s office had requested the gag order last month to remain in place for the duration of the trial. In the civil fraud case last fall, Trump was twice fined for violating Judge Arthur Engoron’s gag order and making comments about the judge’s staff.

CNN —A New York judge on Friday formally ordered Donald Trump to pay $454 million, including interest, a move that will give the former president one month to post nearly half a billion dollars to appeal the fraud verdict. Judge Arthur Engoron’s signed judgment was posted to the court docket Friday, one week after he found Trump, Donald Trump Jr. and Eric Trump liable for fraud in the civil case brought by New York Attorney General Letita James. Once Trump and the others are served with the judgment, the 30-day clock for them to file an appeal starts. The sons were each ordered to pay $4 million back in gains they improperly received because of the fraud. The judge notified both sides in an email Thursday that he would sign off on the proposed judgment drafted by the New York attorney general’s office.

Practically, Engoron’s decision will impose severe financial and personal strain on Trump as he’s emerging as the almost certain Republican presidential nominee. “He’s already said he’s going to spend most of this year in a courtroom, not on a campaign trail. Flouted rules, new realities and a busted legal strategyTrump’s belief that the rules are for others defines his business and political life. Yet this refusal to ever admit defeat also appears to be leading Trump into dangerous legal territory. His flawed philosophy that in business and life, it’s all about closing one more deal, means that even crushing defeats like the 2020 election and his fraud trial cannot change him.

The former president publicly fulminated against Judge Lewis Kaplan as “nasty” and a “Trump-hating guy” and bucked courtroom etiquette. Trump accused Kaplan of being heartless for not suspending the trial so that he can attend the funeral of his mother-in-law. But Haley has only implicitly criticized Trump’s assault on democracy, false claims of electoral fraud and tumultuous term in office. This attitude is consistent with Trump’s apparent belief that rules that apply to other Americans don’t constrain him. “That aside, it’s just remarkable how much the former president has gotten away with in court.

New York CNN —Donald Trump urged a New York appeals court to continue to pause the gag order against him in his civil fraud trial, saying that threats to the judge and his law clerk do not “justify” limiting the former president’s constitutional right to defend himself. Lawyers for the New York attorney general’s office and the court last week urged the appeals court to put the gag order back in place following “serious and credible” threats that have inundated Judge Arthur Engoron’s chambers since the trial began in October. Trump’s attorneys wrote in a filing Monday that the former president has never threatened the judge or his principal law clerk and they can’t be held responsible for actions taken by others. At the time the appeals court judge said he would lift the gag order to allow a fuller panel of judges to weigh in given the constitutional issues at play. Nor have President Trump or his counsel ever made a statement referencing the Principal Law Clerk’s religion, appearance, or private activities,” they told the appeals court.

The witness stand in Justice Arthur Engoron’s courtroom at 60 Centre St., in Lower Manhattan, is an ordinary wood-paneled box off to the side of the bench. But for Donald Trump, who is on trial for fraudulently overvaluing his New York real estate assets, it might as well be a cage of kryptonite. That signature rambling filibuster has propelled Mr. Trump through every venture of his life, from real estate to reality television to the American presidency. He relies on it to control the room, to manipulate the crowd, and to avoid addressing any topic he doesn’t want to. That doesn’t work in court, where the judge is in charge, the rules of evidence are in effect and the witness has sworn to tell the whole truth.

“It is an extremely hostile judge,” Trump added, raising his hand to point at Engoron, who sat beside and just above the witness box on the bench. President.” Trump has long posed as the alpha male and his entire business and political creed — in person and on social media – is based on intimidation. But the trial quickly became a test of wills between Trump and Engoron over who controlled the court. But by the end of the day, Engoron’s resolve frayed: “It feels like a broken record,” he said of Trump’s answers. This desire to make a reality just what he wants it to be has long defined Trump’s political approach.

Former U.S. President Donald Trump speaks on the day he attends the Trump Organization civil fraud trial, in New York State Supreme Court in the Manhattan borough of New York City, U.S., November 6, 2023. Engoron at one point said Trump’s answers were repetitive and irrelevant and warned that he might dismiss Trump as a witness, though that never came to pass. "You’ve made it important, but it wasn’t," Trump said in reference to the New York Attorney General's office that brought the case. "This is a very unfair trial, very, very unfair, and I hope the public is watching," said Trump, a Republican who has accused elected Democrat James of political bias. CNN —A higher court on Thursday denied Ivanka Trump’s request to postpone her upcoming testimony in her father’s civil fraud trial, shortly after she claimed she’d suffer “undue hardship” if forced to appear during a school week. With the appeal, Trump sought to block New York Judge Arthur Engoron’s previous order for her to testify until an appeal could be heard by the New York appellate court. The appeal also asked the court to pause the entire fraud trial against former President Donald Trump, two of his adult sons and his company until her appeal could be heard. Ivanka Trump’s two adult brothers – Donald Trump Jr. and Eric Trump, who both helped run the Trump Organization while their father was in the White House – made back-to-back appearances in court earlier Thursday. Engoron last week ordered Ivanka Trump to testify Wednesday in the trial, denying a motion from her attorney to quash a subpoena.

REUTERS/Jim Bourg/File Photo Acquire Licensing RightsNEW YORK, Nov 1 (Reuters) - Donald Trump’s son Donald Trump Jr. is set to testify on Wednesday afternoon in a New York civil fraud trial accusing the former U.S. president and his family businesses of inflating asset values to dupe lenders and insurers. Donald Jr., an executive vice president at the Trump Organization and a co-defendant in the case, will be the first of Trump’s adult children to take the stand, followed by Eric and Ivanka Trump. He has a campaign event scheduled in Houston on Thursday, when Eric Trump is set to testify. Donald Jr., who along with fellow co-defendant Eric Trump largely took over management of the Trump Organization from his father in 2017, is a central player in the case, overseeing crown jewels of the Trump real estate empire.

CNN —The former controller of the Trump Organization says that Eric Trump directed him to make certain decisions that led to the inflated valuations of several Trump properties. Jeff McConney, also a co-defendant of former President Donald Trump, Eric Trump and Donald Trump Jr., testified Friday as the first week of the civil fraud trial came to an end. (Attorneys for Eric Trump have argued he was not aware that any phone conversations with McConney were used to formulate value assets in the financial statements for Trump properties.) McConney testified that he did not know at the time that Trump had deeded away his right to develop the property beyond its use as a social club in 2005. He said he did this at the direction of Eric Trump, who oversaw the project.

CNN —A New York appeals court judge on Friday rejected Donald Trump’s attempt to stop the ongoing $250 million civil fraud trial, but temporarily halted the process of breaking up his businesses. We’re not seeking anything but a fair trial and these errors permeate the ongoing trial,” Trump attorney Christopher Kise said in court Friday, referring to “an avalanche of errors” in the summary judgment ruling. “And tellingly, they waited until after Mr. Trump decided to stop attending the trial,” the letter says. Trump attorneys and his co-defendants notified the appellate court that they’ve agreed with the New York Attorney General Letitia James’ office to discontinue the suit. Engoron handed down the summary judgment ruling last week, causing the appellate court to deny Trump’s request for a stay as moot because Engoron ruled as they requested.

CNN —A New York judge has found Donald Trump and his adult sons liable for fraud, saying the Trumps provided false financial statements for roughly a decade. Judge Arthur Engoron’s ruling came days before the civil case involving the New York attorney general’s office and the former president was set to go to trial. Engoron granted Attorney General Letitia James’ motion for summary judgment, finding Trump, his sons, and others “to be liable as a matter of law for persistent violations” of New York state law. He found the financial statements the Trumps provided to lenders and insurers for about a decade to be false and said they repeatedly engaged in fraud. In the order, the judge rejected Trump’s deposition testimony in which the former president said that the financial statements were not fraudulent because they contained disclaimers.
